That the plaintiff's kothi is being damaged by such business running therein and the house tax is liable to be increased due to the the accommodation from residential to commercial purpose, and is also objected by the Municipal Corporation, as the colony is purely a residential area not a commercial or industrial one.

4. That it is expedient that the defendant be restrained from converting the use of the building.
